State-Mandated Flood Risk Notification Effective March 20, 2024

The New Jersey law on flood risk notification, P.L. 2023, c.94, becomes effective on March 20, 2024, requiring landlords and sellers of real property to disclose known and potential flood risks.

Real Estate Sales: Sellers of real property must disclose 1. whether the property is located in FEMA’s Special Flood Hazard Area or Moderate Flood Hazard Area and 2. actual knowledge concerning the property's flood risks. 2. Flood risk information via the Seller's Property Condition Disclosure statement must be made before the purchaser becomes obligated under any property purchase contract.

Landlord and Tenants: The landlord must provide written notice to all prospective renters whether the rental property is in FEMA’s Special Flood Hazard Area or Moderate Flood Hazard Area, including actual knowledge that any portion of the rental premises, including common and parking areas, has been subjected to flooding.
